1) Scope of Application

These General Terms and Conditions (GTC) of Our Sake Company GmbH apply to all contracts for the delivery of goods concluded via the online shop. They also apply to vouchers and tickets, unless otherwise regulated. Consumers are natural persons acting outside their trade or profession. Entrepreneurs are persons or legal entities acting in the course of business.

2) Conclusion of Contract

Product descriptions are not binding offers. Customers submit binding offers via the order form or by e-mail. The Seller may accept within 5 days by confirmation, delivery, or payment request. When PayPal is chosen, acceptance occurs when the order is confirmed by clicking the final button.

3) Right of Withdrawal

Consumers generally have a right of withdrawal. Further details are contained in the Seller’s withdrawal policy.

4) Prices and Payment Terms

Prices include VAT unless stated otherwise. Delivery outside the EU may incur additional costs (duties, bank fees). Payment methods are shown in the shop. Supported providers include PayPal, Klarna, Shopify Payments, Stripe, and SumUp.

5) Delivery and Shipping Conditions

Delivery is made to the address provided. Failed deliveries due to Customer fault may incur costs. Risk transfers upon delivery to the Customer (consumers) or carrier (entrepreneurs). Seller may withdraw if suppliers fail. Pickup is available at business address. Vouchers and tickets are delivered by download.

6) Retention of Title

Ownership remains with the Seller until full payment has been made.

7) Liability for Defects (Warranty)

Statutory warranty law applies. For entrepreneurs: Seller chooses form of rectification; limitation 1 year for new goods, excluded for used goods. Exceptions apply for fraud, building materials, or statutory update obligations. Consumers asked to report transport damages immediately.

8) Liability

Seller is fully liable for intent, gross negligence, injury to life, health, guarantee, or mandatory product liability.

For negligent breaches of essential duties, liability is limited to foreseeable damages. Otherwise, liability is

excluded.

9) Redemption of Gift Vouchers

Gift vouchers may only be redeemed in the Seller’s shop. Valid for 3 years after purchase. Multiple vouchers can be combined. No cash payment, no interest, non-transferable.

10) Applicable Law

German law applies, excluding UN sales law. For consumers, protection under mandatory laws of their habitual residence remains unaffected.

11) Place of Jurisdiction

For merchants or legal entities in Germany, jurisdiction is the Seller’s business seat. For foreign customers, the same applies if contract is commercial. Seller may also sue at the Customer’s seat.

12) Alternative Dispute Resolution

The Seller is neither obliged nor willing to participate in dispute resolution before a consumer arbitration board.
